Express Scripts Cannot Avoid MTA Prescription Fraud Claims


By Kellie Mejdrich (March 2, 2022, 8:16 PM EST) — Express Scripts cannot escape a lawsuit from the New York City Transit Authority accusing the drug benefit management company of violating the terms of its contract by authorizing prescription drug costs to balloon millions of dollars, a federal judge has ruled.

District Judge Jesse M. Furman, in an order Tuesday, denied most of the pharmacy benefits manager’s motions for summary judgment, rejecting Express Script Inc.’s biggest claims – that the transportation agency in common had not established damages and that the contract contained no obligation to detect and prevent fraud.
